The Proto Hub Terms and Conditions

1. Acceptance of Terms : –

By registering, accessing, or using theprotohub.com (“The Pro Hub”), users acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions, along with all associated policies—including the Privacy Policy, Content Policy, and Community Guidelines. If you do not agree with any part of these terms, you must not access, register, upload content, or use the platform in any manner. Continued use of the platform after updates or policy changes will be treated as acceptance of the revised terms.

2. Platform Overview : –

The Proto Hub is a digital platform where Designers can upload and showcase prototype demonstration videos, and authorized Investors/Recruiters can view them for evaluation, feedback, collaboration, or potential funding opportunities.

The platform provides :

  • Secure hosting and display of prototype demo videos
  • Watermarked viewing to protect intellectual property
  • Controlled access for verified investors and companies
  • Communication channels for professional inquiries

However :

  • Prototype Hub is not responsible for guaranteeing employment, funding, partnership, recognition, or commercial success.
  • All decisions made between Designers and Investors are independent of the platform, and The Proto Hub does not participate in negotiations, agreements, or legal arrangements between parties.

The platform acts solely as a showcase and discovery medium, not as a recruitment agency, financial advisor, or commercial broker.

3. User Roles :-

The Proto Hub supports multiple user categories with different access permissions and responsibilities:

Designers :

  • Upload prototype demo videos and related project details
  • Showcase innovation to potential investors, recruiters, and industry experts
  • May specify licensing terms such as “view only” or “restricted usage”
  • Must ensure content is original, safe, and compliant with platform policies
  • Receive engagement, feedback, or interest from investors or companies

Investors / Recruiters :

  • View and evaluate published prototypes for collaboration, funding, hiring, or partnership opportunities
  • Can contact designers through authorized platform channels
  • Must not copy, download, or redistribute any prototype without permission
  • Must comply with confidentiality and intellectual property guidelines

4. Intellectual Property :-

Ownership of User Content :

  • Designers retain full intellectual property rights over their prototype videos, images, descriptions, and related content.
  • The platform does not claim ownership of any user-generated content.

License Granted to the Platform :

  • By uploading content, Designers grant Prototype Hub a non-exclusive, worldwide, royalty-free license to:
    • Store, process, display, and stream content on the platform
    • Generate watermarked or compressed versions for security and performance
    • Share content with verified and authorized investors or recruiters inside the platform
  • This license is strictly for platform operations and does not permit resale, commercialization, or external distribution of user content.

User Responsibility :

  • Users must upload only content they own or have legal rights to share.
  • Content must not violate any copyright, patent, trademark, trade secret, or confidentiality obligations.

Prohibition on Unauthorized Use :

  • Other users (including investors, recruiters, or viewers) are not allowed to:
    • Copy, download, re-upload, reverse engineer, or commercially use content
    • Share it outside the platform without written permission from the owner

IP Violation & Takedown :

  • If any content is found or reported to be infringing, stolen, or impersonated, the platform may remove it, restrict access, or suspend the account.
  • The platform may require proof of ownership during disputes to protect the real content creator.

5. Licensing :-

If a user reports or provides evidence of stolen or impersonated content, The Proto Hub may remove it and take appropriate action.

Ownership of Prototypes :

All prototypes, videos, images, and related materials uploaded by a designer remain the intellectual property of the designer. The Proto Hub does not claim ownership of user-created content.

Licensing Permission Granted to The Proto Hub :

By uploading content, the designer grants the Proto Hub a non-exclusive, worldwide, royalty-free license to:

Store, process, and display the content on the platform.

Generate watermarked versions.

Publish content for review by investors, recruiters, and platform users.

This license exists only for platform operational purposes, not for resale or redistribution.

User-Defined Licensing :

Designers may specify their own licensing terms such as “view only,” “no download,” or “restricted usage.”

If no license is specified, the default license will be:
✔ “View only” — other users may view the video on the platform but may not download, re-upload, or commercially use it.

Prohibited Use of Designer Content :

Investors, recruiters, or viewers may not copy, download, share externally, reverse engineer, or commercially use any prototype without explicit permission from the creator.

6. Privacy and Data Collection :-

The Proto Hub collects, uses, and protects personal information in accordance with its Privacy Policy and applicable data protection laws. The following categories of data may be stored and processed to provide a secure and efficient service:

Registration & Profile Information :

  • Full name, email address, mobile number
  • Country, company/organization details (if applicable)
  • Username, password (securely encrypted), and account preferences

Payment & Subscription Data :

  • Plan type, billing details, amount paid, and transaction reference
  • All financial transactions are processed through secure, PCI-DSS-compliant third-party payment gateways.
  • The platform does not store full card or banking details.

Technical & Security Logs :

  • IP address, browser version, device type, access timestamps
  • Login history, session activity, and fraud-prevention signals
  • Used for platform security, analytics, and service improvement

Uploaded Content & Metadata :

  • Prototypes, videos, images, descriptions, comments, and related metadata
  • Stored securely for publishing, watermarking, and validation

Communication Records :

  • Emails, support requests, feedback, and platform notifications
  • Used to improve customer service and maintain account security

7. Usage Restrictions : –

By using The Proto Hub, all users agree NOT to engage in any of the following activities:

  1. Upload or share prohibited content :
    • Any illegal, offensive, violent, sexually explicit, defamatory, or policy-violating material
    • Content that infringes on copyrights, patents, trademarks, or intellectual property of others
  2. Distribute harmful or malicious files :
    • Viruses, trojans, malware, spyware, harmful scripts, or attempts to exploit system vulnerabilities
    • Any action intended to disrupt platform operations or steal user data
  3. Misrepresent prototypes or provide false information :
    • Fake results, exaggerated claims, misleading demonstrations, or fraudulent submissions
    • Uploading prototypes you do not own or have rights to publish
  4. Harass, threaten, or abuse others :
    • Spamming, unwanted messaging, solicitation, fake job offers, attempts to scam users
    • Personal attacks, discrimination, bullying, hate speech, or offensive behavior
  5. Bypass platform rules or security protocols :
    • Impersonating individuals, companies, or identities
    • Circumventing payment systems, subscription limitations, or content restrictions
    • Attempting to gain unauthorized access to accounts, backend systems, or internal data
  6. Engage in illegal business activities :
    • Money laundering, phishing, fraud, resale of stolen intellectual property, or unlawful transactions
    • Encouraging or instructing others to commit illegal acts
  7. Manipulate ratings, reviews, or engagement :
    • Fake accounts, bots, artificial boosting, or coordinated manipulation

8. Prohibited Content :-

To maintain a safe, legal, and respectful environment, the following content is strictly prohibited on The Proto Hub. Any account found engaging in these activities may face content removal, suspension, or legal action.

Harmful, Violent, or Terror-Related Content :

  • Promotion of violence, terrorism, extremism, self-harm, or criminal activity
  • Prototype demonstrations designed to cause harm to people, property, animals, or public safety

Sexually Explicit or Inappropriate Material :

  • Adult content, nudity, pornography, vulgar representations, or sexually suggestive behavior
  • Content involving minors in any harmful or inappropriate context

Misleading, Fraudulent, or Fake Prototypes :

  • False claims, manipulated results, copied inventions, intellectual property theft
  • Uploading content belonging to someone else without permission or ownership rights

Hate Speech or Harassment :

  • Insults, discrimination, or targeting individuals or groups based on race, religion, gender, nationality, or personal attributes
  • Bullying, threats, stalking, or abusive communication

Illegal Activities, Scams, or Financial Fraud :

  • Phishing, impersonation, fake identities, hacking, money laundering, or illegal transactions
  • Content encouraging users to engage in unlawful activities

Malware or Malicious Code :

  • Prototypes, software, apps, or files containing viruses, backdoors, crypto-mining scripts, trojans, or harmful code
  • Any attempt to compromise platform security or user data

Dangerous Experiments or High-Risk Demonstrations :

  • Prototypes involving explosives, weapons, harmful chemicals, or unsafe mechanical designs
  • Uploads that threaten public health, safety, or environmental standards

Socially Sensitive or Government-Restricted Content :

  • Political propaganda, election influence, fake news, or content violating local or international regulations

9. Platform Rights :-

To ensure safety, compliance, and a fair user experience, The Proto Hub reserves full rights to:

  1. Remove or restrict content :
    If any prototype, video, image, or text violates our policies, infringes intellectual property, contains harmful material, or is reported for suspicious activity.
  2. Suspend, limit, or terminate user access :
    Accounts may be restricted or permanently disabled with or without prior notice for violations of our Terms of Use, community guidelines, or legal compliance requirements.
  3. Report unlawful or suspicious activities :
    Any content or user behavior involving fraud, harassment, threats, IP theft, impersonation, or other illegal acts may be reported to relevant authorities or affected parties.
  4. Refuse, delay, or remove published content :
    The platform may decline to publish or continue displaying content that does not meet quality standards, security guidelines, payment rules, or identity verification requirements.
  5. Modify features, rules, or policies :
    The platform may update features, pricing, terms, and policies at any time to improve security, user experience, or regulatory compliance. Continued usage after updates implies acceptance.
  6. Conduct routine or manual content review :
    The platform may run automated scans or manual checks for watermark, video validation, identity verification, spam detection, IP compliance, or data accuracy.

10. Ownership and Intellectual Property : –

All prototypes, videos, images, descriptions, documentation, and related materials uploaded by Designers remain the exclusive intellectual property of their respective owners. The Platform does not sell, transfer, license, distribute, or claim ownership over any prototype or content submitted by Designers. Designers are solely responsible for ensuring that their submissions are original and do not infringe upon any patents, copyrights, trademarks, trade secrets, or proprietary rights of any third party.

Authenticity and IP Certificate Disclaimer :

All prototype submissions are uploaded directly by Designers. The Platform does not verify, authenticate, or guarantee originality, ownership, patent status, technical performance, commercial value, or market readiness.The Proto Hub may issue an IP Certificate for each published prototype. This certificate acts only as a timestamped digital confirmation of submission, watermarking, and publication on the Platform. It is not a legal patent, copyright registration, or official IP ownership certificate.The watermarked version of the prototype is stored for up to five (5) years as part of the Data Retention Policy. After the defined retention or certificate-expiry period, data is permanently deleted and cannot be recovered.Any legal disputes regarding originality or ownership must be resolved directly between the involved parties. The Platform assumes no liability for such disputes.

Commercial Transactions Between Designers and Investors :

The Platform does not participate in, mediate, facilitate, or guarantee any sale, purchase, investment, licensing, partnership, or commercial transaction between Designers and Investors. If an Investor wishes to purchase, invest in, or collaborate on a prototype, all agreements and communications must be handled directly between the involved parties. The Platform is not a party to such transactions and assumes no liability or responsibility for negotiations, contracts, payments, disputes, misrepresentation, losses, failures, or outcomes of any kind. All commercial risks and responsibilities lie solely with the Designer and Investor.

Intellectual Property Disputes and Legal Claims :

Any legal disputes, copyright complaints, ownership conflicts, or intellectual property infringement claims relating to submitted prototypes shall be handled directly between the concerned parties. The Platform shall not be liable for damages, financial losses, reputational losses, legal fees, or consequences arising from such disputes. However, if a verified legal complaint is received from a rightful owner, the Platform reserves the right to remove or disable access to the disputed content in accordance with applicable laws and internal policies.

Platform Fees and Charges :

The Platform charges Designers for services such as prototype hosting, secure video storage, showcasing features, IP certificate eligibility (where applicable), and subscription-based services. The Platform also charges Investors for secure access to prototype listings, viewing permissions, and related subscription features. All applicable fees and service details are clearly displayed on the Membership Plan and/or Checkout pages. Membership fees are charged solely for Platform usage and services, and not for the sale, transfer, or commercialization of any prototype.

11. No Guarantees or Refunds :-

  • The Proto Hub does not guarantee job placement, investment success, or prototype authenticity.
  • All fees paid (e.g., subscriptions) are non-refundable.

12. Account Termination :-

The platform reserves the right to suspend or terminate user accounts in the event of policy violations, misuse of services, fraudulent activities, or any actions that may harm the platform, its users, or its reputation.Users may request termination of their account by submitting a request through the Contact Us page and selecting the appropriate category for Account Deletion. The request must include all mandatory information and supporting documents required for verification. Upon successful verification, the account and all associated data will be scheduled for permanent deletion in accordance with our data retention and security policies. Once the deletion process is completed, the account and its data cannot be recovered under any circumstances. Users will not be able to request data restoration, retrieval, or recovery after deletion.

13. Changes to Terms :-

Terms may be updated at any time. Continued use of the platform implies acceptance of changes.

14. Membership Plan Evolution and Access Restructuring:–

Membership plans, pricing tiers, and access limits are subject to change based on platform evolution and business requirements. Continued use of The Proto Hub constitutes acceptance of any future modifications to plan structure, pricing, or entitlements.

15. Governing Law :-

These Terms and any disputes arising from or relating to them shall be governed by the laws of India. Users agree that any legal proceedings related to the platform shall be brought before competent courts in India, and shall be resolved in accordance with applicable Indian legal and regulatory frameworks.

16. Acceptance of policies :-

I have read and agree to the Privacy Policy , Watermark Policy , Data Retention Policy , Prototype Originality & Dispute Policy , Shipping / Delivery Policy (Digital Services), Refund Policy , Return Policy , Disclaimer of theprotohub.com.
