The Proto Hub Designer Terms & Conditions
1. Acceptance of Terms : By registering, accessing, or using theprotohub.com (“The Pro Hub”), users acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions, along with all associated policies—including the Privacy Policy, Content Policy, and Community Guidelines. If you do not agree with any part of these terms, you must not access, register, upload content, or use the platform in any manner. Continued use of the platform after updates or policy changes will be treated as acceptance of the revised terms. Consider "theprotohub.com" is the domain of the brand name "The Proto Hub".
2. Intellectual Property Rights : Designers retain full ownership of all intellectual property associated with the prototypes, videos, images, descriptions, and related materials they submit to The Proto Hub. The platform does not claim any proprietary rights over user-generated content.
By uploading content, Designers grant The Proto Hub a non-exclusive, worldwide, royalty-free license to:
- Store, process, and display the content within the platform ecosystem
- Generate watermarked versions for certification, security, and showcase purposes
- Share content with verified Investors and Recruiters under controlled access permissions
This license is strictly limited to operational use within the platform and does not authorize resale, redistribution, or external publication.
Designers are solely responsible for ensuring that:
- Their submissions are original and do not infringe upon any third-party intellectual property rights
- They possess all necessary rights and permissions to upload and share the content
- Licensing terms (e.g., “view only,” “restricted usage”) are clearly specified at the time of submission
The Proto Hub encourages Designers to pursue formal IP registration (e.g., patents, copyrights) independently, as Prototype Submission Certificates issued by the platform serve only as timestamped digital records and are not substitutes for legal IP registration.In the event of an intellectual property dispute, The Proto Hub may provide verified submission logs, watermarked video records, and metadata to support the Designer’s legal claim, but does not act as a legal arbitrator or party to the dispute.
3. Usage and Restrictions : Designers are expected to use The Proto Hub responsibly, ethically, and in full compliance with all applicable laws and platform policies. By accessing and using the platform, you agree to the following usage terms and restrictions:
A. Permissible Use
- Upload only original prototype content that you own or have full legal rights to share.
- Ensure that all submitted information, including descriptions, metadata, and video demonstrations, is accurate, truthful, and free from misrepresentation.
- Use the platform solely for the purpose of showcasing your innovations to authorized Investors and Recruiters.
B. Prohibited Conduct
You agree not to engage in any of the following activities:
- Uploading content that is illegal, offensive, defamatory, or violates the rights of others.
- Submitting content that contains viruses, malware, harmful code, or attempts to exploit platform vulnerabilities.
- Misrepresenting the functionality, ownership, or originality of your prototype.
- Uploading content that infringes upon third-party intellectual property, including patents, copyrights, trademarks, or trade secrets.
- Attempting to bypass subscription requirements, licensing restrictions, or platform security protocols.
- Engaging in fraudulent behavior, impersonation, or any form of deceptive conduct.
- Harassing, threatening, or soliciting other users, including Investors or platform staff.
C. Platform Integrity
- The Proto Hub reserves the right to monitor, review, and moderate all user-generated content to ensure compliance with these terms.
- Violations may result in content removal, account suspension or termination, and reporting to legal authorities where applicable.
- The platform may conduct automated or manual reviews to detect prohibited content, enforce watermarking, and validate prototype authenticity.
Designers are solely responsible for the content they upload and for ensuring that their use of the platform does not compromise the rights, safety, or experience of other users. The Proto Hub maintains a zero-tolerance policy toward abuse, fraud, and intellectual property violations.
4. Privacy : The Proto Hub is committed to protecting the privacy and personal data of all users, including Designers. All data submitted, collected, or processed through the platform is handled in accordance with our Privacy Policy and applicable international data protection laws, including the General Data Protection Regulation (GDPR), the Digital Personal Data Protection (DPDP) Act (India), the California Consumer Privacy Act (CCPA), and the UK-GDPR.
A. Data Collection & Usage
As a Designer, the following categories of personal and prototype-related data may be collected:
- Registration details: full name, email address, phone number, country, organization (if applicable), and username
- Uploaded content: prototype videos, descriptions, metadata, and licensing preferences
- Technical logs: IP address, browser type, device information, and timestamps
- Subscription and payment records: plan type, transaction reference, and billing details (processed via secure third-party gateways)
This data is used exclusively for:
- Account management and platform access
- Prototype certification, watermarking, and showcase functionality
- Security monitoring, fraud prevention, and compliance auditing
- Communication and support services
B. Data Storage & Security
- All data is encrypted in transit (via HTTPS/SSL) and at rest (via Google Cloud Storage).
- Access to stored data is strictly controlled through role-based permissions and audit logging.
- Original prototype videos are retained for up to six (6) months; watermarked versions are retained for up to five (5) years for certification and dispute resolution purposes.
C. Disclosure & Consent
- The Proto Hub does not sell or rent Designer data.
- Data may be shared only with verified platform partners (e.g., Investors) under controlled access, and only with the Designer’s explicit consent.
- In the event of a legal request or regulatory inquiry, The Proto Hub may disclose verified records (e.g., watermarked videos, submission logs) but will never share original unwatermarked files without written authorization or a binding court order.
All privacy-related inquiries or requests must be submitted via the Contact Us page, selecting the appropriate category for proper routing and response.
5. Personal Data via Forms : As part of the registration process, membership plan purchase, or prototype submission, Designers may be required to provide personal data through platform forms. The Proto Hub collects and processes this information solely for operational, security, and support purposes, in accordance with its Privacy Policy and applicable data protection laws.
A. Data Categories
The following personal data may be collected via forms:
- Full name, email address, and mobile number
- Country of residence and organization details (if applicable)
- Username and account preferences
- Prototype metadata, licensing selections, and submission details
- Identity verification documents (for issuance of Prototype Submission Certificates)
B. Purpose of Collection
This data is used to:
- Create and manage Designer accounts
- Enable secure access to platform features and investor dashboards
- Generate watermarked prototype records and certification documents
- Facilitate communication, support, and dispute resolution
- Ensure compliance with platform policies and legal frameworks
C. Data Handling & Consent
- All form submissions are encrypted and stored securely in accordance with industry standards.
- Personal data is never sold or rented and is shared only with authorized platform partners under controlled access, and only with the Designer’s explicit consent.
- Designers may withdraw consent or request data updates by submitting a formal request through the Contact Us page.
By submitting personal data via platform forms, Designers acknowledge and agree to its use for the purposes outlined above. The Proto Hub remains committed to safeguarding user privacy and maintaining transparency in all data handling practices.
6. Payment & Plan Data : The Proto Hub processes Designer subscription payments and plan-related data with strict adherence to industry standards for security, transparency, and compliance.
A. Subscription & Billing Information
When a Designer subscribes to a membership plan, the following data may be securely collected and stored:
- Plan type and selected features
- Transaction reference ID and payment status
- Billing amount and applicable taxes
- Subscription start and renewal dates
All financial transactions are processed through verified third-party payment gateways (e.g., Razorpay, PayPal) that comply with PCI-DSS standards. The Proto Hub does not store full card details, banking credentials, or sensitive payment information on its servers.
B. Data Retention & Compliance
- Payment and invoice records are retained for a period of seven (7) years to comply with accounting, taxation, and refund verification requirements.
- Subscription metadata may be used to validate access rights, plan eligibility, and prototype retention timelines.
C. Refund & Plan Modification Policy
- Designers may choose to upgrade their subscription plan through their account dashboard at any time. Upon activation, the subscription is non cancellable, non-transferable, and non-downgradable until the end of its validity period.
- All Designer subscription fees are non-refundable, except in cases of duplicate transactions or platform service failure, as outlined in the Refund Policy.
- Modifications to published prototypes (e.g., re-certification or replacement) require resubscription to the applicable plan at the current rate, subject to administrative approval.
D. Payment Disputes & Support
Designers must submit any payment-related inquiries, disputes, or refund requests through the Contact Us page, selecting the appropriate category for faster resolution. The Proto Hub strives to respond to all form submissions within 1–2 business days.
7. Technical Data (via USP Pro & Security Tools) : To ensure platform integrity, fraud prevention, and service optimization, The Proto Hub automatically collects and processes technical data through its USP Pro module and integrated security tools. This data is used exclusively for operational monitoring, user protection, and compliance enforcement.
A. Data Categories Collected
The following technical information may be recorded:
- IP address and geolocation metadata
- Browser type, device model, and operating system
- Referring URL and session origin
- Timestamp of login, submission, and activity events
- Prototype upload logs and security scan results
B. Purpose of Collection
This data supports:
- Real-time fraud detection and spam prevention
- Validation of prototype authenticity and submission integrity
- Monitoring of suspicious access patterns or policy violations
- Enforcement of watermarking, licensing, and data retention protocols
- Performance optimization and user experience improvements
C. Data Handling & Security
- All technical data is encrypted in transit and stored securely in compliance with global data protection laws.
- Access to this data is strictly limited to authorized platform personnel and automated systems governed by role-based permissions and audit logging.
- Technical logs may be retained as part of the platform’s compliance and dispute resolution framework.
D. Designer Transparency
Designers acknowledge and consent to the collection of technical data as part of their use of The Proto Hub. This data is not used for profiling or marketing purposes and is never shared externally except in cases of verified legal requests or platform abuse investigations.
8. Licensing : Designers submitting prototype content to The Proto Hub are responsible for defining and managing the licensing terms under which their content may be viewed or accessed by authorized users. Licensing governs how your prototype videos and related materials are displayed, protected, and interacted with on the platform.
A. Default Licensing Terms
If no specific licensing preference is selected at the time of submission, the platform will apply a default “view only” license. Under this license:
- Investors and Recruiters may view the prototype video within the platform interface
- Downloading, copying, redistribution, or external use is strictly prohibited without the Designer’s explicit written consent
B. Custom Licensing Options
Designers may choose from the following licensing configurations:
- “View Only” – content may be viewed but not downloaded or reused.
- “Restricted Usage” – content may be viewed with limited reuse rights, subject to Designer approval.
- “No External Use” – content is strictly confined to platform viewing and cannot be shared externally.
Licensing preferences must be clearly indicated during submission. The Proto Hub will enforce these terms through watermarking, access controls, and investor usage restrictions.
C. Platform Enforcement & Protection
- All prototype videos are automatically watermarked with The Proto Hub’s brand identity to prevent unauthorized use and establish authenticity.
- Watermarked versions are retained for up to five (5) years as part of the platform’s certification and dispute resolution framework.
- Original, unwatermarked files are retained for six (6) months and are not used for public display or certification purposes.
D. Designer Responsibility
Designers are solely responsible for:
- Understanding the implications of the selected license
- Ensuring that their content complies with applicable intellectual property laws
- Reporting any suspected misuse or licensing violations through the Contact Us page
The Proto Hub does not mediate licensing disputes but will provide verified submission records, access logs, and certification metadata to support legal claims when necessary.
9. Reporting and Dispute Resolution : The Proto Hub provides a structured process for Designers to report suspected violations, protect their intellectual property, and seek resolution in cases of content misuse or originality disputes. While the platform does not act as a legal arbitrator, it offers verified documentation and procedural support to assist Designers in pursuing independent legal action when necessary.
A. Reporting Violations
Designers may report the following concerns through the Contact Us page:
- Suspected copyright or intellectual property infringement
- Unauthorized reuse or replication of prototype content
- Fraudulent investor behavior or unethical engagement
- Platform misuse or policy violations affecting their submissions
All reports must include sufficient detail and supporting evidence to initiate a formal review. The Proto Hub’s administration team will assess each case in accordance with internal policies and applicable laws.
B. Originality Disputes
In the event of a dispute regarding prototype originality or duplication:
- The concerned Designer must submit a Formal Dispute Request via the Contact Us page
- The platform will verify submission timestamps, watermarked video records, identity logs, and digital hash signatures
- A neutral review report will be prepared and shared with all involved parties
If no evidence of copying is found, all submissions are treated as independent. The Proto Hub’s findings are based solely on digital records and do not constitute legally binding IP judgments.
C. Platform Role and Limitations
- The Proto Hub maintains neutrality and does not participate in financial negotiations, ownership claims, or legal proceedings between Designers and Investors
- The platform may, upon valid request, provide verified submission certificates, access logs, and metadata to support a Designer’s legal claim
- Identity verification data is never shared externally without explicit consent or a binding legal order
Designers are encouraged to retain their Prototype Submission Certificates and pursue formal IP registration for additional protection. The Proto Hub remains committed to supporting Designers with transparency, documentation, and procedural integrity.
10. No Job Guarantee or Related Services : The Proto Hub operates solely as a digital platform for showcasing prototype demonstrations to verified Investors, Recruiters, and industry professionals. While the platform facilitates visibility and engagement, it does not provide or guarantee any employment, investment, contractual, or commercial outcomes.
A. Platform Scope
- The Proto Hub does not act as an intermediary, agent, or representative in negotiations between Designers and Investors.
- The platform does not endorse, validate, or influence investor decisions, prototype selections, or business arrangements.
- All interactions initiated through the platform are at the sole discretion of the involved parties.
B. No Guarantees
Designers acknowledge and agree that:
- Use of the platform does not guarantee job placement, funding, partnership, or commercial success.
- The Proto Hub does not offer recruitment services, investment facilitation, or business matchmaking.
- Any outcomes resulting from prototype visibility or investor engagement are independent of platform involvement.
C. Independent Agreements
- Any agreement, contract, or transaction formed between a Designer and an Investor is strictly between those parties.
- The Proto Hub is not liable for the terms, execution, or consequences of such arrangements.
- Designers are responsible for conducting their own due diligence and seeking independent legal or professional advice where necessary.
By using The Proto Hub, Designers accept that the platform’s role is limited to content hosting, certification, and controlled exposure—not career placement or financial brokerage.
11. No Refunds : All payments made by Designers to The Proto Hub, including subscription fees, certification charges, or service-related costs, are non-refundable under all circumstances, unless explicitly stated otherwise in the platform’s Refund Policy.
A. Policy Scope
- Subscription fees are considered final once payment is successfully processed.
- No refunds will be issued for dissatisfaction with platform features, early account termination, or unused services.
- The Proto Hub does not guarantee investment outcomes, job placement, or commercial success; therefore, refunds will not be granted based on engagement results.
B. Exceptions
Refunds may be considered only in the following limited cases:
- Duplicate transactions caused by system error
- Failure by the platform to deliver the purchased service as described
All refund requests must be submitted within seven (7) calendar days of the transaction date via the Contact Us page, including complete transaction details and supporting documentation. Approved refunds will be processed within 7–14 business days.
C. Financial Records & Compliance
- Payment and invoice records are retained for seven (7) years to comply with accounting, taxation, and audit requirements.
- Designers are encouraged to retain their own transaction confirmations for reference and reconciliation.
By subscribing to any plan or service, Designers acknowledge and accept the terms of this No Refunds policy and waive any claim for reimbursement outside the conditions explicitly defined above.
12. Termination : The Proto Hub reserves the right to suspend, restrict, or permanently terminate a Designer’s account at its sole discretion in response to violations of platform policies, legal obligations, or ethical standards. Termination may occur with or without prior notice depending on the severity of the breach.
A. Grounds for Termination
Designer accounts may be terminated for reasons including, but not limited to:
- Uploading fraudulent, plagiarized, or prohibited content
- Repeated violations of intellectual property or licensing policies
- Misrepresentation of prototype ownership, functionality, or identity
- Harassment, impersonation, or unethical engagement with other users
- Attempts to bypass subscription, licensing, or security protocols
- Abuse of platform features, submission tools, or certification systems
B. Consequences of Termination
Upon termination:
- Access to the Designer dashboard, prototype content, and certification records will be revoked.
- Previously issued Prototype Submission Certificates may be invalidated.
- All active submissions will be removed from investor-facing dashboards.
- The platform may retain metadata and access logs for compliance, audit, or legal support purposes.
C. Platform Rights & Limitations
- The Proto Hub is not liable for any loss of data, opportunity, or reputation resulting from account termination.
- The platform may block future registration attempts or IP-based access if abuse is repeated or severe.
- Terminated accounts are not eligible for refunds, reactivation, or content restoration unless explicitly approved by platform administration.
Designers are expected to maintain professional conduct and adhere to all platform terms. The Proto Hub enforces a zero-tolerance policy toward fraud, abuse, and intellectual property violations to protect the integrity of its ecosystem.
13. Changes to Terms : The Proto Hub reserves the right to modify, update, or revise its Terms & Conditions, platform policies, features, and service offerings at any time, without prior notice. These changes are made to reflect evolving legal requirements, technical improvements, user feedback, and platform enhancements.
A. Scope of Changes
Modifications may include, but are not limited to:
- Updates to submission requirements, licensing options, or certification procedures
- Adjustments to pricing, subscription plans, or refund eligibility
- Revisions to enforcement policies, privacy practices, or data retention timelines
- Introduction or removal of platform features, tools, or access controls
B. Notification & Acceptance

14. Governing Law : These Terms & Conditions, along with all related policies and agreements applicable to Designers, shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
A. Jurisdiction
- Any dispute, claim, or legal proceeding arising out of or relating to a Designer’s use of The Proto Hub shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
- Designers agree to submit to the personal and territorial jurisdiction of these courts for the resolution of any such matters.
B. Legal Compliance
- Designers are responsible for ensuring that their use of the platform complies with all applicable local, national, and international laws, including intellectual property, data protection, and commercial regulations.
- The Proto Hub reserves the right to cooperate with law enforcement agencies and regulatory authorities in the investigation of any alleged illegal activity or policy violation.
C. Language of Interpretation
- In the event of any conflict between translated versions of these Terms & Conditions, the English version shall prevail and serve as the authoritative reference.
By using The Proto Hub, Designers acknowledge and accept that all legal matters shall be interpreted and enforced under the jurisdiction and laws specified above.

- All communications must be professional, respectful, and free from abusive or misleading language.

- Designers are responsible for ensuring that their contact details remain accurate and up to date.
By using The Proto Hub, Designers agree to communicate through the designated channels and acknowledge that platform support is limited to operational, technical, and procedural matters.
16. User-Generated Content (UGC) and Prohibited Content : Designers are solely responsible for all content they upload, submit, or publish on The Proto Hub, including but not limited to prototype videos, descriptions, metadata, and licensing selections. All such content is considered User-Generated Content (UGC) and must comply with the platform’s content standards, applicable laws, and ethical guidelines.
A. Ownership and Responsibility
- Designers must ensure that all submitted content is original, lawful, and free from third-party intellectual property violations.
- By uploading content, Designers affirm that they have full rights, licenses, or permissions to use and display the material on the platform.
- The Proto Hub does not claim ownership of Designer content but reserves the right to store, display, watermark, and certify it for platform functionality and compliance purposes.
B. Prohibited Content
The following types of content are strictly prohibited and may result in immediate removal or account termination:
- Content that infringes upon copyrights, trademarks, patents, or trade secrets
- Plagiarized, misleading, or fraudulently represented prototypes
- Content containing hate speech, harassment, threats, or discriminatory language
- Pornographic, sexually explicit, or graphically violent material
- Malware, viruses, or any code intended to disrupt platform functionality
- Content that promotes illegal activity, misinformation, or unethical conduct
- Attempts to impersonate other individuals, organizations, or platform staff
C. Moderation and Enforcement
- The Proto Hub reserves the right to review, moderate, or remove any content that violates these terms or undermines platform integrity.
- Automated and manual review systems may be used to detect prohibited content, enforce watermarking, and validate originality.

17. No Modification of Designer Content :
A. The Platform does not edit, modify, or alter any prototype submitted by Designers.
B. All content is published exactly as provided.
C. Designers are fully responsible for ensuring the accuracy, originality, legality, and completeness of the content they upload.
18. Platform Rights Regarding Prohibited Content : The Proto Hub maintains the right to monitor, moderate, and enforce content standards to preserve the integrity, safety, and legal compliance of the platform. Designers acknowledge that all submissions are subject to review and that prohibited content will be addressed in accordance with the platform’s enforcement policies.
A. Monitoring and Detection
- The platform may use automated tools, manual review processes, and third-party services to detect prohibited, harmful, or non-compliant content.
- Monitoring may include analysis of uploaded videos, metadata, submission patterns, and account behavior.
- Detection mechanisms are designed to uphold platform standards, prevent abuse, and protect the rights of all users.
B. Enforcement Actions
The Proto Hub reserves the right to take any of the following actions, with or without prior notice:
- Remove or disable access to content that violates platform policies or applicable laws
- Suspend or terminate Designer accounts involved in repeated or severe violations
- Invalidate associated Prototype Submission Certificates or licensing records
- Restrict future access to submission tools, certification features, or investor dashboards
C. Legal and Compliance Cooperation
- The platform may retain logs, metadata, and submission records related to prohibited content for audit, dispute resolution, or legal proceedings.
- In cases involving intellectual property infringement, fraud, or regulatory violations, The Proto Hub may cooperate with relevant authorities and provide verified documentation upon lawful request.
D. No Liability for User Content
- The Proto Hub does not assume liability for the accuracy, legality, or originality of Designer-submitted content.
- Designers are solely responsible for ensuring that their content complies with all applicable laws, licensing terms, and platform policies.
By using The Proto Hub, Designers acknowledge and accept the platform’s right to enforce content standards and take appropriate action to maintain a secure, ethical, and compliant environment.
19. Authenticity and Accuracy of Prototype Videos : Designers are solely responsible for ensuring that all prototype videos submitted to The Proto Hub are authentic, accurate, and representative of the actual functionality, design intent, and ownership of the prototype. The platform relies on the integrity of submitted content to maintain trust, certification validity, and investor confidence.
A. Content Integrity
- All prototype videos must reflect the genuine capabilities, features, and intended use of the submitted innovation.
- Designers must not use simulated footage, misleading edits, or third-party content that misrepresents the originality or functionality of the prototype.
- Any enhancements, animations, or overlays must be clearly distinguishable and not imply false performance or capabilities.
B. Ownership and Representation
- Designers must submit only content they own or have full legal rights to display and certify.
- Submissions must not include borrowed, stock, or externally sourced footage unless explicitly licensed and disclosed.
- Misrepresentation of ownership, authorship, or development history may result in certification invalidation and account termination.
C. Certification and Review
- The Proto Hub issues Prototype Submission Certificates based on the timestamped video and metadata submitted by the Designer.
- Certification does not imply technical validation, patent review, or commercial endorsement.
- The platform may conduct manual or automated reviews to verify authenticity, detect duplication, and enforce content standards.
D. Consequences of Misrepresentation
- Submissions found to be misleading, plagiarized, or fraudulent may be removed without notice.
- Associated certificates may be revoked, and the Designer’s account may be suspended or permanently terminated.
- The Proto Hub may retain submission logs and metadata to support dispute resolution or legal inquiries.
By submitting prototype videos, Designers affirm that the content is truthful, original, and accurately reflects their innovation. The Proto Hub enforces strict standards to preserve the credibility of its showcase and certification ecosystem.
20. Platform Disclaimer Regarding Video Authenticity : The Proto Hub provides a certification framework for timestamping and watermarking prototype videos submitted by Designers. However, the platform does not independently verify the technical accuracy, functional claims, or originality of the content beyond the scope of submission metadata and automated checks.
A. No Technical Validation
- The Proto Hub does not test, audit, or validate the underlying technology, performance, or feasibility of the prototypes depicted in submitted videos.
- Certification confirms only the date, time, and identity associated with the submission—not the authenticity of the prototype’s claims or capabilities.
- Designers are solely responsible for ensuring that their content is truthful, lawful, and free from misrepresentation.
B. No Endorsement or Guarantee

21. Platform Authority and Rejection Rights : The Proto Hub reserves full authority to review, approve, reject, or remove any Designer submission at its sole discretion. A. Submission Review and Approval
- Designers do not have publishing rights; they can only submit drafts for review.
- Content visibility and accessibility are controlled entirely by the Platform Administrator.

- Designers waive any claim against the platform for rejection-related outcomes, including visibility loss, certification denial, or missed engagement opportunities.

22. Enforcement & Platform Actions : The Proto Hub maintains the right to enforce its policies, protect platform integrity, and take corrective action against any Designer account or submission that violates the Terms & Conditions, applicable laws, or ethical standards. Enforcement decisions are made at the sole discretion of the platform and may be executed with or without prior notice.
